Info about EPO (by angelo cuzalina) & Time-Line of ACTUAL Events

The pain of having to endure these surgeries was more than what I could bear, but apparently that wasn't enough & the situation was made even worse. To my surprise, on Aug 31, 2012, when I was leaving tulsa surgical arts, angelo cuzalina serves me with an EPO (aka Emergency Protective Order), stating that he is receiving threats (as mentioned below) from me. In below time-line, I have mentioned angelo cuzalina's Complaint details (left side) & to the right side, I have mentioned details about the other actual events.

Instead of writing 10,000 words about what I think, I will only mention (a) Actual time-line events. & (b) Some of the effects of this EPO.

FACT

• On Sept 13, 2012 angelo cuzalina's complaint (aka this EPO) against me was dismissed from court in less than 5 minutes.
• angelo cuzalina did not even show up to defend his allegations (i.e. he was not even present during the court hearing).

Note:
Obviously there are lot more events (than mentioned below), however, I have listed only few main points.

Important Note

Timing of this EPO along with my severe health issues compounded the problems & because of these factors, I was worried that I might not be able to file the medical malpractice case against angelo cuzalina (in timely manner) & if that would have happened, then angelo cuzalina could have easily walked away - as many a times a surgeon's lawyer can simply say that the case was not filed within legally allowed time & hence it should be dismissed. Though filing the malpractice case (against angelo cuzalina) was important, the more urgent task for me (at the time of epo) was first to get the infected implants (implant from angelo cuzalina's surgery) removed & also to find a good attorney to successfully deal with the court hearing for epo case.

Having to undergo an additional surgery to remove these infected implant & the headache + time required to deal with epo was substantial. However, I am happy to say that regardless of all the problems, I was still able to file the case against angelo cuzalina before the statute of limitation expires. However, the fact remains that the only reason I was able to take required steps in timely manner is because I received help from lots of wonderful people, especially those at Saint Francis Hospital - Tulsa, OU Hospital - OKC & not to mention my attorney Paul. Who was able to help me understand the details of my case & was able to take required actions in timely manner. Thanks, you all!!!!)

Few Notes for above Events

Would like to start by saying, Thank you to all the wonderful people who helped me. Second: am also releaved that, though both EPO & existing health problems were successful in delaying me from filing the medical malpractice law suit against angelo cuzalina, I was still able to recover enough to file the court case on him (angelo cuzalina) before the statute of limitation expires.

2. June 6, 2012 & June 19, 2012 (Time-line Point: 2 & 3)
   Note 1: There is no law on the planet that I am aware of that requires a surgeon to do surgery on a patient, if the patient represents any threat to him or his staff's lives!!
   Note 2: In addition, if he is getting death threats from me & is afraid for his & his staff's lives (at my hand), he & his staff members are automatically disqualified for doing surgery on me - in such situation, no surgeon can work with patient's best interest in mind.


3. July 1, 2012 (Time-line Point: 5)
   Note 1: Correct me if I am wrong, but I believe, "If a person is giving someone death threats, most people would not keep that person informed/posted with their vacation plans & where about of their kids!!


4. July 4, 2012 (Time-line Point: 7)
   Note 1: Interesting timing, since in the police report angelo cuzalina writes that I was giving him death threats & my behavior was hostile.


5. July 15, 2012 (Time-line Point: 8)
   Note 1: I am 10000% sure that no parent would send a picture of their 3 year old daughter to someone who is giving them death threats.
   Note 2: This picture will be submitted as evidence in court, however, I believe it would be wrong to publish this picture.


6. July 16, 2012 (Time-line Point: 9)
   Note 1: One of the picture taken during the party, clearly shows angelo cuzalina 'SMILING', while he is sitting less than 5 feet away from his 3 year old daughter (who is eating the ice cream that I purchased & brought from outside) . I can only think of one situation in which a father would be smiling (a) When he knows his daughter is not in any danger, However, if someone believes that there is any other possibility then please let me know.
   Note 2: I do not know about the rest of the world, I am pretty freakin sure that I would never allow anyone I know to eat anything (ice cream, in this situation) from someone, if that someone was showing intent to kill (or harm in any way) me or any of them. However in this case, angelo cuzalina is not only bringing his own kids (age 3 & 7, at the time of party), but 4 other kids (about the same age as his kids) too.
   Note 3: This pictures will be submitted as evidence in court, however, I believe it would be wrong to publish this pictures. Regardless of my fight against angelo cuzalina, I do not believe it is right to publish pictures of innocent kids.

How this EPO will effect rest of my life (only few points listed below):

Note: Even though this complaint was dismissed from court in less than 5 minutes it will stay on my record & keep hurting me for rest of my life.

1. This complaint will stay on my name/record 'forever'.
2. While trying to rent a house or apartment, they would do a background check & though I don't' know all the details about how real estate property management people do all their work - I do feel comfortable saying that, such an EPO on my records, saying that I was giving death threats to a doctor, would surely not help me.
3. While applying for any reasonably good job they would do a background check & such epo complaint on my name/record would hurt me.
4. Though angelo cuzalina personally never showed up in court to defend his complaint & though the complaint was dismissed from court (in less than 5 minutes), why would someone want to take a chance with me, when its likely that there will be 20 other applicants with similarly good resume applying for the same position??
5. If I were to consider seeing any surgeon for my breathing problem & rebuild the nose, I would have to provide them with my medical records. However, angelo cuzalina has also made notes in my medical records that talks about above allegations (i.e. I was hostile & was giving threats, etc.) - I for one believe that with such negative information in my medical records, it would make things so much more difficult for me to find a surgeon to treat me- after all, though in court, it might be innocent until proven guilty, in real world, it is pretty much guilty until proven innocent.
